Rental Car Damage Responsibility Explained

Subject to the law where the vehicle was rented, Section 3 states that the renter is responsible regardless of fault for damage to, loss of, or theft of the vehicle during the rental and lists several components that may be included.

  • Physical Damage includes loss or damage from collision, theft, vandalism, weather, civil disturbance, fire, flood, and other causes described by the definition.
  • For a total loss, the listed measure is full fair retail market value less salvage.
  • For repairable damage, Section 3 describes either a before-and-after value difference or reasonable estimated retail/actual repair cost plus Diminution of Value.
  • The listed components also include Loss of Use and a damage-based administrative fee.
